March/April 2004: The marriages spread, along with lawsuits
|
Following Newsom’s lead, in March and April thousands of same-sex couples are granted marriages in Oregon, New York, New Mexico, and New Jersey — while the San Francisco marriages are shut down by a court injunction, spawning the lawsuit Woo v. Lockyer in California. |

In April, the American Civil Liberties Union of Washington files suit in Castle v. State on behalf of 11 couples and their children. Whereas Andersen challenged the county’s prohibition on marriage licenses for same-sex couples, this case directly challenges the state DOMA on behalf of all Washington couples. Some of the Castle couples were married in Canada, so it also adds the component of recognition: must out-of-state marriages, such as those granted in Canada and Massachusetts, be recognized by the State? |
